When you purchase a home in an HOA, you will be given a lot of documents to sign. Some of these documents will be the sale contracts, while others will be documents that represent that you received the Governing Documents for the HOA itself. You must take the time to read and understand all of these documents before you sign them.

One of the most important documents that you must receive is the HOA’s Declaration, also known as the HOA’s covenants, conditions, and restrictions (CC&Rs). This document outlines the rights and obligation of both the HOA and you, as a member. You should take the time to read this document carefully so that you know what is expected of you as a member.

Another important document is the By-laws. The By-laws outline how the HOA is operated by the Board of Directors and the procedures that the Board must follow. You should make sure that you understand these procedures before you agree to them.

You may receive a copy of the HOA’s Rules and Regulations, which govern the use of the property within the HOA. You should read these rules carefully so that you know what is and is not allowed.

The Declaration, or CC&Rs, the By-Laws, the Articles of Incorporation and the Rules & Regulations are all considered to be the Governing Documents of the HOA. Once you have read and understood all of these documents, you will be able to make an informed decision about whether or want to become a member of the HOA buy purchasing a home within the HOA Community. Be sure to ask your real estate agent if the home you are considering purchasing is governed by an HOA and for the agent to obtain all the Governing Documents before you decide to purchase.

If you have any questions, about any of the Governing Documents, you could attempt to ask a member of the Board or the Property Manager, however, the most prudent course of action is to ask one of the Association lawyers at Ferrer Law Group.
